0.1     These terms and conditions shall govern the use of our website.

0.2     By using our website, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website.

0.3     If you [register with our website, submit any material to our website or use any of our website services], we will ask you to expressly agree to these terms and conditions.

0.4     You must be at least 16 years of age to use our website; and by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 16 years of age.

0.5     Our website uses cookies; by using our website or agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our privacy and cookies policy.

1 Formation of the contract

1.1 These terms of sale apply to all goods supplied by Marine Engine Servicing.

1.2 No contract exists between you and Marine Engine Servicing for the sale of any goods until Marine Engine Servicing has received and accepted your order and sends you confirmation by email to the email address you have given. Once Marine Engine Servicing does so, there is a binding legal contract between the two parties.

1.3 The contract is subject to your right of cancellation (see below).

1.4 Marine Engine Servicing may change these terms of sale without notice to you in relation to future sales.

2 Description and price of the goods

2.1 The description and price of the goods you order will be as shown in Marine Engine Servicing’s website at the time you place your order. Reasonable effort will be made to ensure the description and price are correct, however Marine Engine Servicing will not be held responsible for any errors given on price or the description based on third party information and Marine Engine Servicing have final say over any price or description discrepancy.

2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available for delivery within 28 days, Marine Engine Servicing will inform you as soon as possible, and refund you for any sum that has been paid.

2.3 Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found, Marine Engine Servicing will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, Marine Engine Servicing will refund you for any sum that has been paid.

2.4 In addition to the price, you will be required to pay a delivery charge for the goods.

2.5 The price of the goods and delivery charges are inclusive of VAT unless otherwise stated.

3 Payments

3.1 Payment for the good/s and delivery charges can be made by any method shown on our website at the time you place your order with us.

3.2 Payment may be made by cash on orders under £100.00 pounds or over £100.00 by prior approval.

3.3 Payments made by debit card maybe made on any valued goods/service.

3.4 Payments made using credit card are subject to 2% card charge because of service charges on our card readers.

3.5 All payments are issued with receipts and invoices to corresponding purchase/s.

3.6 Declinded card payments must be resolved at the most convenient time within 24hrs or goods will be returned and future business maybe compromised.

4 Deliveries

4.1 The goods you order will be delivered to the address you give when you place your order.

4.2 If delivery cannot be made to your address, Marine Engine Servicing will inform you as soon as possible.

4.3 If there is no one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods.

4.4 Every effort will be made to deliver the goods as soon as possible after your order has been accepted, and in any event within 28 days of your order. However, Marine Engine Servicing will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this case, Marine Engine Servicing will inform you as soon as possible.

4.5 You will become the owner of the goods you ordered and responsible for risk of loss of or damage to them once they have been delivered to you. Subject to payment in full being made.

4.6 If the courier contracted to deliver the goods, are unable through no fault of the carrier to deliver the goods, either, the goods being refused or no contact by the purchaser with either Marine Engine Servicing or the delivery contractor, within 7 days from the notification of non delivery to arrange redelivery or alternative collection arrangements, Any subsequent redelivery will be subject to an additional delivery charge.

4.7 International delivery costs will be calculated separately.

5 Your right of cancellation

5.1 You have the right to cancel the contract at any time up to the end of seven working days after you receive the goods (see below). A working day is any day other than weekends and bank or other public holidays.

5.2 To exercise your right of cancellation, you must give written notice to Marine Engine Servicing by email, giving details of the goods ordered and (where appropriate) their delivery.

5.3 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to Marine Engine servicing at your own cost. The goods must be returned to the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.

5.4 Once you have notified Marine Engine Servicing that you are cancelling the contract, Marine Engine Servicing will refund you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.

5.5 If you do not return the goods as required, Marine Engine Servicing will charge you a sum not exceeding the direct costs of recovering the goods.

5.6 You do not have the right to cancel the contract if the order is for audio or video recordings or computer software which has been unsealed by you, or for goods which by their nature cannot be returned or are liable to deteriorate or expire rapidly as well as order to specification parts, such as tele-flex cables etc. Marine Engine Servicing will notify you at the time your order is accepted if this applies.

6 Warranties

6.1 All goods supplied by Marine Engine Servicing are warranted free from defects for 12 months from the date of supply. This warranty does not affect your statutory rights as a consumer.

6.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by Marine Engine Servicing, or failure to follow Marine Engine Servicing’s instructions, or any alteration or repair carried out without Marine Engine Servicing approval.

6.3 If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods, you should notify Marine Engine Servicing in writing via email address.

6.4 Used items such as used outboards and parts, are not covered by the 12 months warranty as above. Used outboards and parts are subject to individual conditions of warranty .Please ask Marine Engine Servicing for details.

 

7 Data protection

7.1 Marine Engine Servicing will take all reasonable precautions to keep the details of your order and payment secure, but unless Marine Engine Servicing is negligent, Marine Engine Servicing will not be liable for unauthorised access to information supplied by you.

7.2 Marine Engine Servicing will only use the information you provide about yourself for the purpose of fulfilling your order, unless you agree otherwise. You can correct any information about you, or ask for information about you to be deleted, by giving written notice to
Marine Engine Servicing via email.

7.3 The data received / gained from electronic engine diagnostics, will be unless stated otherwise, be the property of Marine Engine Servicing this being said, a copy of all relevant date will be presented to the official owner of said engine as a copy.

8 Applicable laws

These terms of sale and the supply of the goods will be subject to English law, and the English courts will have exclusive jurisdiction in respect of any dispute arising from the contract.

9 Acceptance of goods

The acceptance of goods from Marine Engine Servicing is regarded as being in affect the formation of a contract without written reference to such goods on the customers part, this being said the goods still fall under the same rules as mentioned above.
Moreover this section might only apply in kind to such goods as spark plugs and small consumables where a contract may not be applicable.
The acceptance of goods from Marine Engine Servicing in this section fall under the same guide lines as in section 4.
As stated here Marine Engine Servicing can and will exercise their right to refuse a return from accepted goods if we feel the goods may have or have been tampered with for financial or personal gain in a claim against us.

10. NGT fishing
Orders taken from our NGT fishing catalogue are for orders with a minimum purchase value of £150.00 in total.
This is due to shipping charges from our supplier.

11. Shipping Charges

Marine Engine Servicing charge a stranded rate of shipping based on the value of each individual or total item volume/weight with items total falling into a category.

12. Lawn Mower Servicing

Marine Engine Servicing, offer petrol lawn servicing for the stated £30.00. Only for a standard signal cylinder petrol lawn mower with direct drive ( no drive belt ) system.
Parts needed in addition to the standard service will be charged at an extra cost to the customer. Free pick-up and delivery is subject to Marine Engine Servicing’s opinion upon distance.
Failure to pay upon demand/return or within a given stated pre-arranged period will result in the customer’s serviced property being sold to recover costs with brokerage fees on top of price.
Sold item’s assets will become the sole property of Marine Engine Servicing and no other.

13. Engine Servicing / Work Carried out

Marine Engine Servicing carry out all servicing by qualified engineers unless otherwise stated / a trainee under supervision etc, but in all cases at least one qualified engineer will be present.
During an engine service any advice about the engine and its structure / health is Marine Engine Servicing opinion regardless if it’s proofed otherwise.
If parts are found to be defective Marine Engine Servicing will always try and fix the problem if possible. Or if parts are required will ask the owner first of how they would like to proceed. Work and servicing carried out are done to the highest standards however a service is no guarantee that the engine will be serviceable after unless the engine is seen to be running prior to servicing commencing. Example – Engine fails to start – No blame is accepted under any circumstances by Marine Engine Servicing.

14. Failure To Pay Marine Engine Servicing

If a customer fails to pay or cannot pay Marine Engine Servicing within a given specified time or 30 days from invoice issue then the following will happen –

A final invoice demand will be sent to the address of payer – outlining a final request for the payment containing the details of the original payment agreement you had with us, as well a notice of  Court procedures leading to  filing a claim against you for the amount due if you are unable to make payment within the 7 days of the request issue date.

You will also be held liable for interest and Court fees.

* If the Amount Owed is Less Than £750. Then a HMRC Claim will be taken out against you and you will be taken a Small Claims Court.

*If the Amount Owed is Greater than £750. Then a Statutory Payment Demand will be issued against you.
